Lua error in package.lua at line 80: module 'strict' not found.

It is submitted that use of the image in the article "Ötzi the Iceman" is fair under U.S. copyright law, and the laws of other jurisdictions where applicable, for the following reasons:

Image is not replaceable. Ötzi is now housed at the South Tyrol Museum of Archaeology in Bolzano, Italy. For preservation reasons, it is highly unlikely that visitors to the museum will be permitted to take photographs of the body. Therefore, it is also unlikely that an image which does not rely on the doctrine of fair use is easily obtainable.

  • The image is small and of a low resolution.
  • Use of the image in the article is unlikely to impair the sale of the original, high-quality photograph.
