Summary

Production box shot of Delrina's ComSuite 95, from a colour flyer of the time. Not strictly speaking a video game cover, but is the closest applicable category ("Software cover" would be more appropriate).

Fair Use in Delrina

  1. It's a low resolution copy of a now-obsolete product box cover.
  2. It doesn't limit the copyright owner's rights to sell the software in any way, and in fact may encourage interest and possibly sales.
  3. Because of the low resolution, copies could not be used to make illegal copies of the album artwork for another product box.
  4. The products within the image are subjects of discussion within the article.
  5. The image on the cover is significant because it references several products made by the firm.
  6. Derived from a digital capture (scan/photo) of the product box (creator of this digital version is irrelevant as the copyright in all equivalent images is still held by the same party). Copyright held by the current owner of this now-obsolete software. Claimed as fair use regardless.

This DOES hold up under the 9 criteria for non-free content:

  1. No free equivalent
  2. Respect for Commercial Opportunities -- it is the same image as used in vendor's sales catalogs and will encourage sales.
  3. Minimal use -- used only within this article
  4. Content is encyclopedic - article references the software
  5. Falls under fair-use - copyright Delrina, image used by others to showcase the software it references
  6. Used in one-article that describes the software
  7. Significant to the article itself -- it is the image of the subject being discussed in the article.
  8. Located only in the article itself
  9. Source of image and copyright noted
