A Rivera Request, also known as an evidence packet request, is the document used for requesting evidence relating to a New York fair hearing pursuant to the stipulation and settlement in Rivera v. Bane.

The request document is labeled W-186A.

Rules

  • If the Rivera request is made 7 business days before the hearing, then HRA[clarification needed] has five business days to put a reply in the mail. If HRA does not reply within 5 days, the appellant wins the hearing.
  • If the request is made 5 or 6 business days before the hearing HRA must mail an evidence packet. However, if the packet is not mailed, the appellant does not automatically win the hearing; HRA only needs to bring a copy of the evidence packet to the hearing.
