Article | |
Portion used |
A short section sufficient to identify the work concerned, or to aid in critical commentary of the work |
Low resolution? |
The sample is of reduced quality (and or timespan) compared to the original, yet of sufficient resolution for commentary and identification. Copies made from it will be of inferior quality, unsuitable for 'unauthorised distribution' or other uses that would compete with the commercial purpose of the original recording. |
Purpose of use |
Section. The image is used for identification in the context of critical commentary of the work for which it serves as sample. It makes a significant contribution to the user's understanding of the article, which could not practically be conveyed by words alone. Purpose must be stated here. |
Replaceable? |
As a sample from a copyright musical recording, the sample is not replaceable by free content; any other sample from the same recording would also be copyrighted, and any version that is not true to the original would be inadequate for identification or commentary. Using a different sample would be misleading as to the identity of the work. |
Other information |
Use of the sample in the article is understood to be compatible with Wikipedia non-free content policy and fair use under United States copyright law as described above. Use of this sample outside of Wikipedia may be subject to other terms. |
30 second audio sample of the song "Cherish" by pop singer Madonna.
Source: Like a Prayer 1989
Recorded: 1989 Copyright: 1989, Sire Records
Fair use rationale This is a sound sample from a commercial recording. Its inclusion here is claimed as fair use because:
- It illustrates an educational article about an artist that specifically discusses the song from which this sample was taken
- It is a sample of about 20 seconds from a much longer recording, and could not be used as a substitute for the original commercial recording; and
- It is not replaceable with an uncopyrighted or freely copyrighted sample of comparable educational value.
- It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.
- The sample specifically illustrates the opening of the song, the beats and the lyrics sung by Madonna, all of which are critically analyzed in the section titled Composition in the article, where the sample is being placed.
- Notability is established due to these discussions of the characteristics of the sample being used, thus it helps the readers in better understanding of the article. Hence passes WP:NFCC#8 also.
