The image is used for visual identification and illustration of a subject of public interest. The significance of the photograph is to illustrate the visual appearance and style of the subject in an article containing critical commentary about the subject, in a way that words alone could not convey.

Because the design of the toy is copyright protected there is almost certainly no free equivalent. Any equivalent alternatives would also be derivative works. Any substitute that is not a derivative work would fail to convey the meaning intended, would tarnish or misrepresent its image, or would fail its purpose of identification or commentary.
